Happy Law Day everyone! I really enjoyed participating in the Alabama Bar's Statewide effort to educate our kids about the Law. I loved talking to the kids at Liberty Middle School this morning (virtually of course) with my colleague Hope S. Marshall. The kids really had great questions and I was impressed.

But I will admit that seeing the kids in class made me feel bad for my wife who is still homeschooling our kids!

Time for a Friday flex for my firm and awesome assistant Madeline King!

Today we received an order from the Alabama Court of Civil Appeals upholding an order we fought for at the trial level. This marks the 6th or 7th straight “win” at the Appellate level for our firm. And of course I was the trial attorney in all of the decisions that have been upheld, so it helps writing the “second brief!” For the non lawyers that means you won at the trial level! Madeline has been instrumental in getting my records ready for trial and the subsequent appeals!

Thanks to my wonderful wife for not being too angry with me every time I am in a bad mood having to write these Appellate briefs! 🤣

To be clear, I am making this post (and to warn you, it is going to be long) as an AMERICAN, not a Democrat, not a Republican. I am a father of three and a husband, those are my most important jobs. I also still serve this country in the reserves and I am a business owner and lawyer.

Quite honestly I can’t remember being as hopeful as I am now about the state of our national politics. I want to extend a big Congratulations to President elect Biden. And to the first woman VP in the history of America!

This election has obviously highlighted how divided our country is politically but I am hopeful that with a leader that understands a leader’s role is NOT to demonize those that disagree with you politically that we can truly start to heal our nation. I am obviously very thankful that the candidate that is clearly NOT a threat to the fundamental underpinnings of the best form of government known to man (democracy) won this election.

To my Trump supporting friends, I can honestly say that if I ever supported a candidate who engaged in the most unamerican and unpatriotic speeches (seen in the last few days) and the stunts and attacks seen in the lead up to the election (and that continue to this day in not conceding in the face of an overwhelming loss) I would immediately withdraw my support and never support that candidate again. I say that as an American, not beholden to any political party. I truly believe that our founders (and my grandmamma and granddaddy) are smiling down on the “will of the people” being shown today for the only candidate that has shown any sort of true patriotism and love of this great country.

I recently posted a “throw back video” about how McCain (who was runnning against Obama at the time) corrected plain idiocy coming from people who were there supporting him at rallies. Obviously McCain lost to Obama. In looking back, it seems quite possible that if he had catered to demonizing Obama as a “domestic terrorist African Muslim” he could have won... but the country would have lost and McCain would have lost his character.

In my humble opinion the country was lost the last 4 years. Regardless of how you feel about Biden or Trump or what political party you claim, I trust that we as Americans can start to be more like McCain and demand leaders more like McCain as we continue to disagree on any policies we believe the government should implement. I certainly hope so... as Ben Franklin purportedly said, “you have a republic if you can keep it.”

I submit that Mr. Franklin would be pleased at the election results today and will look forward to the frivolous lawsuits being quickly thrown out of court so the will of the people will be expressed in a leader that wants to lead the country for reasons of patriotism and not personal profit. I hope that the nearly 70 million that voted for Trump will also join in looking forward as our country progresses. God Bless this great country and this “little experiment of ours!” Let’s make Ben Franklin and our other founding fathers proud and “keep it!”

He entered the Air Force through the Direct Appointment Program on May 27th, 2005 and began his active duty service on July 3rd, 2005. His official date of separation from active duty was September 28th, 2009. Mr. Howie continues serving the country in the reserves and teaches military trial advocacy at locations worldwide.
