Good news, it's official. Gov. Ivey has signed into law a major expansion of expungement in Alabama. Convictions for possession of ma*****na in the 2nd degree and most other misdemeanors will be expungement eligible. A bit of bad news for those with past DUI convictions, DUI convictions are still not "expunge-able" in Alabama. However, as before, DUI charges that were resolved favorably can still be expunged. In other words, if you are facing a DUI charge, it's as important as ever to hire a good DUI attorney.

This past Friday, April 23, 2021, was a historic day for those with old ma*****na convictions in Alabama. At 4:15 PM, Governor Kay Ivey signed Senate Bill 117, now Alabama Act 2021-286), into law, and it will go into effect on July 1, 2021. This bill will greatly expand the availability of expunge

Expungement will soon be available for misdemeanor possession of ma*****na convictions and many other misdemeanor convictions if Governor Ivey signs a new bill passed by the Alabama Legislature. Unfortunately, DUI convictions will not be among the convictions eligible for expungement. The new law will be effective July 1, 2021 if Governor Ivey signs it before the end of the month. Horse DUI in California! Could this happen in Alabama? The answer is probably. A horse🐴 meets the definition of "vehicle"🚙 in Alabama. Section 32-1-1.1(81) of the Code of Alabama says "a ridden animal shall be deemed a vehicle" and Alabama's DUI statute, 32-5A-191 makes it illegal to "drive or be in actual physical control of a vehicle" while under the influence of alcohol, etc. A possible defense might be that the "drive" or "actual physical control" element is not met. This defense would be stronger if the horse was stubborn and unruly. :)

The California Highway Patrol have a message for the public: “No, you may not ride your horse on the freeway, and certainly not while intoxicated.”
