Mark McDaniel, an attorney with 49 years of experience who said he has handled thousands of hit-and-run cases, said the change doubles the previous penalty.

McDaniel said staying at the scene of a crash — whether it involves another vehicle or a pedestrian — can affect how a judge handles sentencing.

“Render whatever assistance you can to that person because I promise you later on if a judge is looking at the case and you stopped and you’re helping somebody, the judge is going to look at that and say, hey, okay maybe probation… versus you leave the scene of the accident and somebody is hurt or dies, man it’s going to get real bad on you at sentencing,” McDaniel said.

A new Alabama law set to take effect Oct. 1 increases the penalties for leaving the scene of a crash, elevating the offense to a Class B felony carrying a sentence of no less than two years and up to 20 years in prison.
