For a homeowner behind on a mortgage, these are two very different tools — and the right one depends on the whole financial picture, not just the house.

A loan modification changes the terms of the existing mortgage — the goal is to make the monthly payment sustainable. Chapter 13 bankruptcy uses a court-approved plan to catch up arrears over time while the automatic stay halts the foreclosure.

Before a foreclosure case can be filed in New York, your lender generally has to send a 90-day pre-foreclosure notice. That notice is not the end — it's a starting gun, and the clock is on your side more than you'd think.

Those 90 days are for acting: reviewing your options, applying for a loan modification, or getting advice on a defense. What they are not for is waiting and hoping the letters stop.
