Myth: no breath test means no evidence.
Fact: refusing a chemical test after a DUI arrest triggers penalties under California’s implied consent law. Those are separate from, and on top of, anything in the criminal case.
A refusal also adds a fourth issue the DMV has to prove at your hearing.
There are real reasons a person might refuse. Just know what comes with it.

The walk and turn. The one leg stand. The eye test.
None of them are required, and declining carries no automatic license penalty. The chemical test after a lawful arrest is a different story.

A DUI arrest starts two separate cases. One of them has a 10-day deadline.

The DMV can suspend your license automatically unless you request an Administrative Per Se hearing within 10 days of your arrest date. Miss that window and the suspension moves forward on its own, whatever happens in criminal court.
