Assault family violence vs. continuous violence against the family: whatβs the difference? βοΈ
These two charges may sound similar, but in Texas the difference between them can be significant.
Assault family violence usually involves a single alleged incident against a family member, household member, or dating partner. In many cases it is charged as a misdemeanor, though certain circumstances can raise it to a felony.
Continuous violence against the family is different. It can be charged when someone is accused of two or more assaults against a family or household member or dating partner within a 12-month period. Itβs a felony, even if the person has never been convicted before.
Understanding which charge youβre facing, and what the prosecution has to prove, can make a major difference in how your case is handled and whatβs at stake.
