I’m posting this on Facebook as an effort to get the word out since I’ve never had to wind down a business before:

Dear Valued Clients,

I hope that you all had a Merry Christmas and Happy New Year. I’m sorry to inform you that after 10 years of running my solo law practice and 5 years of running a title office, I will be closing my doors. An opportunity has been presented to me that will provide a better work/life balance for myself and my family.

I will continue to close my current title files through the end of January, and if any have not yet closed, Texas Lone Star Title’s corporate office will finish them out. If any involve legal work, I will be able to finish that part of it even if the corporate office handles the closing. You will be in good hands. If after January 31st you need anything from a prior file that you have closed with us, please contact the corporate office at 512.258.5500.

I will no longer be accepting new legal matters involving court proceedings but will be able to finish out the ones that are currently pending. My work days will be devoted to my new employer, however, if you need estate planning documents prepared or for any other transactional or non urgent matters, I may still be able to assist you on weekends or evenings if time allows.

I have valued our relationship greatly. Thank you for your loyalty and friendship over the years. Best wishes for the New Year and your future.

$500 Estate Planning Special! During the month of October only, I’m reducing my rates to less than when I first got licensed in hopes that people who have been procrastinating will decide to take that important step and get their estate planning done. For $500 per person, you can get everything you need that fits your circumstances (trusts not included). This may be a will, medical POA, statutory durable (financial) POA, health directive, designation of guardian for yourself and/or children, designation of agent for your funeral, etc. Call or text me at 832-576-0694 to schedule an appointment.

REMEMBER: When someone who has an exemption on a property dies, the property loses that exemption even if the appraisal district and taxing authority hasn't found out about it yet. Years can go by where the new property owner is paying the taxes based on the former owners exemptions and one day, the appraisal district will find out that the exemption was lost, remove it, and add back taxes on that should have been paid. Even worse is that if the person who now owns the property would have qualified for their own exemption, the appraisal district will only go back 2 years in applying it when a new application is submitted. I recently had a client who inherited a property with an over 65 exemption at a time when he was already 65. He didn't know to change anything and kept paying the taxes. Ten years later, he gets a bill from the tax assessor saying that he owes $16K and that the exemption was removed. He then applies for over 65 exemption and also fills out a form stating that it was removed erroneously because he was over 65 at the time he took ownership of the property. He receives the exemption dating back 2 years but is denied the rest of the years because no application was submitted for those years in the time required. Of course he can now apply to have the taxes deferred so that he is not at risk of losing his house in a foreclose suit but the taxes are still due and will have to be paid by him or by his heirs. So to sum it up, when you receive a property, make sure you update the information with the appraisal district and apply for new exemptions if you qualify for any.
