An operating agreement. This one settles who holds what percentage, who can sign, how money gets distributed, and what happens when a partner wants out. Without it, Texas default rules fill the gaps, and they may not match your intentions.A client services agreement. It should cover scope, deliverables, payment schedule, late fees, and termination. Most billing disputes we see trace back to a document that never defined "done."An independent contractor agreement. This spells out that the person is a contractor rather than an employee, and it assigns ownership of whatever they create for you. Skip it and you may not own the logo, code, or copy you paid for.

August is National Make a Will Month—a good reminder that a will is not just for the wealthy or for later in life.

Do I need a will if I’m married?
Yes. State rules may not reflect your specific wishes, especially for blended families, children, or unique assets.

Do I need a will if I’m not wealthy?
Yes. Estate planning is about clarity and protecting the people you love—not just the value of your assets.

Can a will override beneficiary designations?
Usually, no. Life insurance, retirement accounts, and other assets with named beneficiaries generally pass directly to those individuals, so it is important that those designations match your overall plan.

Will a will avoid probate?
No. A will provides instructions for the probate process. Depending on your goals, other planning tools may help certain assets pass outside probate.

Is a will enough?

Common law trademark rights come from using a name in commerce, and they generally stop at the edges of the territory where you sell. Federal registration with the USPTO is what gives you a claim across all fifty states.

If you started your business without talking to a lawyer first, you are in very good company, and you may also be carrying more personal risk than you realize. The most common mistake we see at The Curry Law Firm is skipping entity formation or choosing the wrong one.

Running as a sole proprietor means there is no legal line between you and the company. A client sues, a vendor goes unpaid, a contract goes sideways, and your personal savings and home are part of the conversation. An LLC creates that separation. It is not a magic shield, and it can be pierced if you mix personal and company funds or ignore the formalities, but it changes the starting position considerably.

The good news is that fixing this usually costs far less than people expect, and at a fraction of what a lawsuit runs. If you have been operating on good intentions and a business bank account, let's sort out the structure before it becomes a problem.

Dying without a will means the state's intestacy rules decide who inherits, in what shares, and often on a timeline your family cannot control.

For a married homeowner with children, the result can be surprising. For example, a property divided in ways that leave a surviving spouse sharing ownership with adult kids, or an heirship proceeding in Harris County Probate Court just to establish who is legally entitled to what. Add a blended family or a business interest, and it gets complicated quickly.
