Does everything have to go through probate?

Not necessarily. And that surprises a lot of people.

In Texas, some assets can pass directly to beneficiaries without going through probate.

For example:
- Life insurance policies with designated beneficiaries
- Retirement accounts with named beneficiaries
- Certain jointly owned property with survivorship rights
- Bank accounts with payable-on-death designations
- Property transferred through a properly executed transfer-on-death deed

But here's where things can get complicated.

Just because someone had a will doesn't mean every asset has to go through probate. And just because someone didn't have a will doesn't mean everything automatically avoids it.

How an asset is titled and whether a beneficiary has been designated can make a significant difference.

Your parenting plan worked when they were 6. They’re 14 now.

A lot can change in eight years.

School schedules change. Activities get more demanding. Parents change jobs or move. Kids develop stronger opinions about where they spend their time. Transportation gets complicated. And the schedule that once made perfect sense can start creating more conflict than consistency.

A custody order or parenting plan doesn't automatically change just because life has.
