There's a belief that stops a lot of mesothelioma families before they start: "If we file with the trust funds, we can't also file a lawsuit. The money would cancel out."

It won't.

Asbestos trust funds, civil lawsuits against companies still in business, and VA benefits for veterans are built on separate legal foundations. Different parties funded them. Different legal frameworks govern them. No payment from one reduces what the others pay. The system was designed for simultaneous pursuit — not a single choice between three sources.

Most patients qualify for 10 to 20 trust funds because a career usually meant exposure to many manufacturers' products across many job sites. One filing against one trust is almost never the full picture. And for veterans, the VA is a separate path alongside both — though mesothelioma is NOT PACT Act presumptive and requires documented in-service exposure plus a physician's nexus letter.
