Client, her husband, and young child were traveling from out of state and were stopped by police for going 66 in a 65. Questioned roadside and consent to search was initially denied. Police called for K9. While they waited, client consented to search, already being inconvenienced for nearly an hour and late on their itinerary. Officer still waited for K9 to arrive.

Dog sniffed and alerted to drugs not “ACTIVELY” being in car BUT in car at ”SOME POINT IN TIME”!?!? Handgun was found in car (was perfectly legal), along with numerous cell phones, and a large amount of cash. Clients taken to station and questioned for hours, threatened, by police, that they would call CPS and take the child away if they didn’t talk. Client had nothing to tell except the same story, legitimate travel plans and use for the money. Eventually, police cut client and her family loose with car but decided to keep the cash, phones, and handgun. They were never given ANY papers confirming what was seized, no idea who would have it, and no idea when they’d get it back.

Fortunately, we were able to get it all back for the client. If you believe people are not “profiled” and harassed every day across America, you need to come out from under the rock you are living. Not sure how a dog can communicate to a human that there used to be drugs in a car but this is the stuff police use to randomly search and interrogate anyone they want. Here in San Diego attending DUIDLA seminar, learning about new strategies and tactics for DWI defense. Took a drug test on a Drager 5000 that “supposedly” can detect drugs in your system via saliva on the spot. Not impressed, and it’s not so immediate.

DWI blood case dismissed today for my client!! Yay!! Glad to give my client his life back. It was a long year of Court appearances for him....

This week was a stress filled week. However, we were able to give a young man his life back this week. High school student was arrested having a gun in his car on school campus after hours following an incident with a rival school. Had a bright future ahead of him until this incident. We were able to, after quite some time, get him a pretrial diversion. As long as he completes it successfully, he can follow his dreams and join the military. Glad we could deliver such a great result...

Got a ALR decision, from a hearing we did in Beaumont, on a DWI where the DPS trooper showed up to the hearing. He pulled up to my guy Bc he saw him pumping gas and "smelled" the odor of alcohol from his car. DWI case was already dismissed and we WON the hearing on the merits. Now his license will not be suspended and after an expunction, he will be back to where he was...
