On October 14, 2026, DHS and USCIS announced a proposed rule that would end the long-standing practice of generally giving deference to prior eligibility determinations when adjudicating nonimmigrant extension petitions. If finalized, this change could affect employment-based categories including H-1B, L-1, O-1, TN, E visas, and others. The proposal is currently open for public comment through November 13, 2026.
