Shareholders Michael Magee and Mark Appling successfully obtained summary judgment on behalf of an oil and gas client in Ector County. The case involved the death of four crew members who were killed while en route to the wellsite from breakfast. The crew member driving the truck was intoxicated at the time and rolled through a stop sign, where it was hit by a semi-truck.

While the motion was opposed by three separate camps of Plaintiffs' lawyers who were pushing for reconsideration, the court ultimately granted summary judgment in our oil and gas client's favor in full.

Shareholder Konor Cormier recently secured a mandamus win in the Texas Fourteenth Court of Appeals.

A trial court in Fort Bend County granted a Rule 202 Petition filed by a personal injury claimant, ordering a corporate defendant to appear for deposition and produce documents before a lawsuit was filed. Konor drafted and filed a petition for a writ of mandamus on behalf of the defendant, seeking to have the court of appeals overturn the order. The Fourteenth Court of Appeals agreed that the plaintiff had not met its burden for needing a pre-suit deposition or discovery and set aside the order.
