Cory Fein Law Firm Announces Million-Dollar Whistleblower Settlement

The Cory Fein Law Firm announces a settlement, unsealed in October 2024, resulting from a False Claims Act qui tam case it filed on behalf of its whistleblower client, a former employee of an optometrist practice. The suit alleged that the defendants billed for optometry services using the NPIs of optometrists who did not perform the services billed, including in situations where the provider rendering services was not credentialed or enrolled in Medicare, Medicaid and/or TRICARE. The October 2024 settlement, in excess of $1 million, includes payment of a 20% relator’s share to the Cory Fein Law Firm’s client. The case is United States and Texas ex rel. M.S., v. Tony Jacob, et al., No. 1:21-cv-01111, W.D.Tex., and the settlement agreement is available by emailing [email protected].

Cory Fein commends his client for providing the information that made the case possible and the W.D. Texas U.S. Attorney’s office (particularly T.J. Parnham) who worked on the case and obtained the settlement.

The settlement alleges that Tony Jacob operated a network of optometry practices in Texas and that he caused the submission of claims for payment to Government healthcare programs (including Medicare, Medicaid and TRICARE), which falsely identified the persons who performed the services.

The Cory Fein Law Firm announces an $8.88 million settlement, unsealed in August 2024, resulting from a False Claims Act qui tam case it filed on behalf of its whistleblower client, a Texas physician with information about an alleged kickback scheme. The June 2024 settlement includes payment of a 19% ($1,688,000) relator’s share to the Cory Fein Law Firm’s client. The case is United States ex rel. J.R., M.D., v. Andrew Gomes, et al., No. 4:18-cv-04650, S.D.Tex., and the settlement agreement is available by emailing [email protected].

Cory Fein commends his physician client for providing the information that made the case possible and the S.D. Texas U.S. Attorney’s office (particularly Julie Redlinger and Andrew Bobb) who worked with him extensively on the case and obtained the settlement.

The settlement alleges that Dr. Andrew Gomes and his affiliated companies (known as National Interventional Radiology Partners PLLC or NIRP) established a network of peripheral arterial disease (PAD) office-based labs that were engaged in an illegal kickback scheme involving podiatrists and doctors investing in PAD labs and referring patients to the labs in order to increase the value of their investments. The complaint alleged Gomes established and developed multiple PAD clinics in Texas by recruiting podiatrists and primary care physicians to invest in the clinics and refer patients to the clinics to maximize the value of their investments. The procedures performed at these clinics (including arteriograms, angiograms, angioplasties and atherectomies) are highly compensated procedures.

Four managed care company employees blew the whistle on their former employer, which billed for psychotherapy services provided by unlicensed and unsupervised people. Under the False Claims Act, whistleblowers can recover a percentage of funds recovered by the Government as a result of their whistleblowing, plus personal damages resulting from any retaliation they experienced as a result of opposing unlawful activity.

The settlement comes after whistleblowers brought a suit against Molina and a former subsidiary, alleging care at Massachusetts-based behavioral health clinics was given by inadequately trained and unsupervised clinicians.
