DEED FRAUD IS HAPPENING — AND HARRIS COUNTY IS TAKING ACTION
Recent news out of Harris County is putting deed fraud back in the spotlight.
Harris County has filed lawsuits against individuals accused of participating in organized property deed theft schemes involving forged signatures, fake identities and fraudulent documents. In some cases, the alleged fraud involved properties belonging to deceased owners and properties that were later sold to unsuspecting buyers.
This is more than paperwork fraud. A fraudulent deed can put someone’s home, equity and generational wealth at risk.
Texas has also enacted new laws strengthening protections against real property theft and fraud, including additional identity verification requirements and tools for county clerks to flag potentially fraudulent filings. Harris County is also preparing a free Property Alert System to notify residents when documents are recorded under their name.
What can property owners do?
• Regularly monitor your property records.
• Pay attention to unexpected notices involving your property.
• Be cautious of unfamiliar documents, liens or deeds.
• If you discover a filing you did not authorize, act quickly and contact the appropriate county authorities and legal professionals.
• When buying or selling property, work with experienced title and escrow professionals who can help identify title issues before they become closing problems.
Deed fraud may not always be obvious until significant damage has already been done.
