I occasionally get inquiries from people who have just been laid off and are required to sign confidentiality and non-disparagement agreements in exchange for receiving severance pay. That demand is now considered unlawful under a recent NLRB decision. However, please note that NLRB rulings do not apply to independent contractors, managers, most supervisors, public sector employees, some agricultural workers, as well as the airline and railroad sectors of employment.
If your company lays you off, your employer might offer you severance pay — but only if you agree to adhere to a number of restrictions.
