Can the insurance company blame a past injury for a new wreck? 📋🧐
Adjusters love digging through your old medical records to find a reason to say "this crash didn't actually do anything to you." But in Texas, we have the "Eggshell Plaintiff" rule. It basically says the insurance company has to take you as they find you. If their driver's negligence makes a pre-existing condition worse, they are still one-hundred percent responsible for that damage. You don't get a discount just because you weren't perfectly healthy before the wreck.
