I recently convinced the district attorney to dismiss a case against a client who was wrongly charged with OWI with a BAC reading of 0.05 (yes, there are many circumstances in which a person can be charged with OWI even though the reading is under 0.08). A vigorous defense and investigation revealed the police and prosecutor had erred in determining the legal standard for evaluating whether the client should have been charged with a crime. The client initially faced a plea offer requiring a permanent criminal conviction on the individual's record, a jail sentence, high fines and court costs, a license revocation, and ignition interlock requirements. In turn, the client would have likely lost his/her job as a direct result of the conviction and penalties imposed.

This case emphasizes the importance of seeking independent legal counsel prior to accepting any plea offer made by the prosecution. If you are charged with a crime or issued a citation (ticket) by a police officer, immediately contact an attorney to discuss your rights.
