PA Supreme Court Decision Could End ARD for First Time DUI Offenses

People facing a first offense for DUI are generally afforded a chance for an Accelerated Rehabilitative Disposition, commonly known as an ARD. This diversion program provides a chance to avoid a conviction and earn a dismissal of the charge in exchange for some probationary supervision, community service and compliance with some other conditions. Part of the trade off for an ARD has always been the understanding that a subsequent offense would be treated as a second offense carrying higher penalties.

On Friday, May 30th the PA Supreme Court ruled in the case of Commonwealth v. Shifflett that using an ARD to make a subsequent DUI a second offense for penalty purposes is unconstitutional.

While the ruling could spare some repeat offenders the harsher sentences a subsequent DUI would otherwise carry, it may have unintended consequences that could make things harder on first time offenders.

Immediately following the Shifflett decision the Pike County District Attorney's Office announced that in light of the ruling, it will no longer extend ARD's to first-time DUI offenders. This means that first offenders will be faced with the decision of pleading guilty or standing trial on the DUI charge and possibly suffering the consequences of a DUI conviction.

At this time, there is no word as to how the Wayne County District Attorney or other District Attorneys in the state will address the Shifflett decision.
