Children May Have a Strong Voice in New Jersey Custody Cases. Tell us if you agree or disagree with this and why below!

Recent changes to New Jersey’s custody laws may expand the circumstances in which children can express their preferences and have their views considered by the court. When a child is of sufficient age and maturity to form a reasoned opinion, the child’s perspective may carry greater weight in custody decisions. The changes provide opportunities for a child to speak privately with the judge, outside the presence of either parent.

These changes may make it even more important to understand whether a child’s expressed preference is genuinely their own—or whether family conflict, pressure, or efforts to undermine a parent-child relationship may be influencing that preference.

One of the most common questions we hear is:
"Can I stop paying the bills now that we're getting divorced?"
In many cases, the answer is no. When a divorce is pending, courts generally expect both spouses to maintain the status quo—meaning continue handling finances and responsibilities the way they did during the marriage until there is a court order or written agreement changing those obligations.
The status quo may include:
✔️ Paying the mortgage or rent
✔️ Maintaining health insurance
✔️ Paying household bills
✔️ Covering regular expenses for the children
✔️ Preserving marital assets

Making major financial changes without consulting your attorney can create unnecessary legal issues and may even be viewed unfavorably by the court.

🎓 "I Can't Afford It" Doesn't Mean You Don't Have to Contribute to College Costs.

One of the biggest misunderstandings we hear is:

"My divorce agreement says I'll contribute to college expenses within my means. I can't afford it, so I don't have to pay anything." That's not true.

In many New Jersey divorce agreements, the phrase "within your means" recognizes that each parent's financial circumstances may be different. It does not excuse a parent from contributing simply because they say they cannot afford it.

Each parent's contribution is generally evaluated based on their actual financial circumstances. One parent may certainly pay a larger share than the other, but both parents ARE EXPECTED to contribute. Don't assume your obligation has disappeared—and don't assume the other parent has no responsibility either.

Before tuition bills are due, exchange updated financial information, and understand what your obligations are.
