This October marks one year since Naor Rom joined Lindsay Chase Law Firm as an attorney! It is hard to believe how much has happened in just twelve months.

From the beginning, Naor has thrown himself into criminal defense. He has worked alongside our team on serious and complex cases, spent countless hours reviewing discovery, researching difficult legal issues, preparing for hearings and trials, meeting with clients, and learning the parts of this profession that simply cannot be taught in a classroom.

One of the things we value most at Lindsay Chase Law Firm is giving young lawyers meaningful experience. We do not believe attorneys become great advocates by sitting on the sidelines. They become great advocates by doing the work, getting into the courtroom, learning from other lawyers, and taking responsibility for the people who have trusted us with their cases.

Naor has embraced every opportunity he has been given.

Over the last year, we have watched his confidence grow along with his abilities as an advocate. He asks questions. He wants to understand not only what we are doing in a case, but why we are doing it. He cares about our clients and understands that criminal defense is about much more than a case number or a charge. Every case involves a real person and often an entire family whose lives have been turned upside down.

That perspective matters.

Building a law firm is about much more than adding attorneys to a website. It is about finding people who share the firm's values and who genuinely care about the work we do. Naor's work ethic, drive, and commitment to our clients have made him an important part of our team. As his firm biography says, his experience over the past year has extended into all facets of criminal defense, and he continues to approach his cases with both precision and empathy.

We are incredibly proud of how much Naor has grown during his first year with the firm, and we are excited to see where the next year takes him.

11 years ago today, I was sworn in as an attorney.

Looking back, it is hard to put into words just how much this profession has given me. Over the last 11 years, I have had the privilege of meeting so many wonderful people, building friendships that extend far beyond the courtroom, and learning from mentors who have shaped the lawyer and person I am today.

I have been trusted to stand beside people during some of the hardest moments of their lives. I have had the opportunity to fight for people, change lives, celebrate incredible victories, and learn from the difficult days too.

This career has challenged me, humbled me, pushed me outside of my comfort zone, and taught me more about myself than I ever expected when I took that oath 11 years ago.

There have been long nights, hard cases, unexpected turns, and plenty of lessons along the way, but I truly would not trade any of it for the world.

I feel incredibly lucky that, 11 years later, I still get to wake up every day and do something I genuinely love.

Last week, I attended an event for the Innocence Project of Florida and had the opportunity to hear Stephanie Spurgeon tell her story.

I have spent my career in criminal defense, and I know how important it is to challenge the evidence, question assumptions, and make sure the State is held to its burden. But hearing Stephanie speak was a reminder of just how devastating the consequences can be when the system gets it wrong.

Stephanie was a mother of two and a longtime home daycare provider when a one-year-old child became critically ill after spending her first day in Stephanie’s care. The child later died from a brain hemorrhage. Despite having no bruises, broken bones, neck injuries, or other external signs of trauma, Stephanie was prosecuted and convicted of manslaughter based largely on medical testimony that the child's injuries had been caused by abuse. She was sentenced to 15 years in prison.

Years later, the science told a very different story.

Post-conviction attorneys presented evidence that the child had signs of an undiagnosed diabetic crisis and a blood clot that an expert testified had formed approximately ten days before she was hospitalized. A biomechanical engineer also testified that the type of brain trauma involved could not have been caused in the manner alleged by the prosecution. Stephanie's conviction was ultimately overturned, and she was released in August 2020 after spending eight years incarcerated.

Today, Stephanie works as a paralegal for the Innocence Project of Florida, helping the same organization that helped fight for her freedom.

Hearing Stephanie tell her story stayed with me. It reminded me that being a criminal defense lawyer is about more than representing the person standing in front of you. It is also about protecting the integrity of a system that can have irreversible consequences when it gets something wrong.

I left that evening wanting to do more.

Going forward, The Law Office of Lindsay Chase will donate $50 from every new client retained by our firm to the Innocence Project of Florida.

The Innocence Project of Florida works to find and free innocent people incarcerated in Florida, help exonerees rebuild their lives, and address the causes of wrongful convictions.

Stephanie lost eight years of her life for a crime she did not commit. We cannot give those years back. But we can support the people doing the incredibly difficult work of making sure the next innocent person gets home.

Such a special night celebrating the Broward criminal defense community at the BACDL Annual Installation and Awards Dinner.

I was honored to be there to celebrate, Jeremy Kroll, this year’s recipient of the Harry Gulkin Award. This award recognizes a lawyer who embodies integrity, kindness, mentorship, friendship, and the highest quality of our profession. It honors someone who truly “raises the bar” and makes our legal community better simply by being a part of it. Jeremy could not be more deserving of that recognition.

It was also wonderful to celebrate Melinda Blostein, recipient of the Brian Reidy “Give Back” Award, which honors a lawyer who carries on Brian’s legacy of hard work in the courtroom and a commitment to giving back through service to the community.

We were also fortunate to hear from Justice Couriel of the Florida Supreme Court as our keynote speaker.

One of my favorite things about this dinner every year is seeing our entire legal community come together. Defense attorneys, public defenders, prosecutors, and judges all in one room celebrating the people who make our profession and our Broward legal community better.

Congratulations, Jeremy and Melinda. So well deserved!

We are incredibly proud of our appellate of counsel, Laura L. Cepero, for securing a reversal in the Fifth District Court of Appeal in Klug v. State.

The trial court had summarily denied Mr. Klug’s Rule 3.850 motion for post-conviction relief. On appeal, the Fifth DCA reversed and remanded ALL seven claims for further consideration.

That matters.

Post-conviction litigation is often the last meaningful opportunity for someone who has already been convicted and sentenced to challenge what happened in their case. These cases are difficult. The standards are demanding. And a summary denial can make a person feel as though every door has closed.

But a summary denial is NOT always the end of the case.

Here, the appellate court found problems with the treatment of multiple ineffective-assistance claims, including claims involving witnesses who were not called, expert testimony that was not presented, evidence that was not properly challenged, objections that were not made, and advice regarding the rejection of a plea offer. The court specifically determined that the claim concerning counsel’s advice to reject a five-year plea offer requires an evidentiary hearing.

This decision is also an important reminder in the post-conviction world: courts cannot simply reject properly raised constitutional claims without following the procedures required by Rule 3.850. When the record does not conclusively refute a claim, the defendant may be entitled to further proceedings, an opportunity to amend, or an evidentiary hearing.

Laura’s work gave this client something extraordinarily important: another opportunity to have his claims heard.

Our firm handles post-conviction matters throughout Florida, including Rule 3.850 motions, ineffective assistance of counsel claims, Rule 3.800 sentencing issues, newly discovered evidence, and appeals from the denial of post-conviction relief.

If you or a family member is serving a sentence and believes that trial counsel made serious mistakes, important evidence or witnesses were not presented, a plea offer was mishandled, or a post-conviction motion was summarily denied, the case may not be over.

HUGE WIN. ⚖️

As a criminal defense attorney, you learn quickly that the odds are rarely stacked in your favor. Post-conviction relief is especially difficult to obtain, which makes victories like this one incredibly meaningful.

Our client was serving a 20-year prison sentence. We challenged that sentence through a Rule 3.850 motion, litigated an evidentiary hearing, and today the Court GRANTED our claim for post-conviction relief and ordered a NEW SENTENCING HEARING.

This is why we keep fighting.

There are no guarantees about what happens next, but our client now gets something incredibly important: another opportunity to stand before the Court and be sentenced at a new hearing.
