🌺 Weird Legal Facts About Divorce & Child Custody in Hawai‘i 🌺

Going through a split or just love random legal trivia? Here are some lesser-known (and kinda wild) facts about divorce and child custody in the Aloha State:

1️⃣ No U.S. Citizenship Needed – You can get divorced in Hawai‘i without being a U.S. citizen, as long as one spouse has lived here for 6+ months.

2️⃣ No Automatic Favor for Moms – Hawai‘i courts focus on what’s best for the child, not the parent’s gender. Either parent can get custody.

3️⃣ Kids Don’t Get the Final Say – There’s no specific age where a child can choose which parent to live with. Their wishes matter—but so do maturity and other factors.

4️⃣ No Island-Hopping with the Kids – Want to move to another island or out of state with your child? You’ll need court approval or the other parent’s OK.

5️⃣ No-Fault, No Wait – You don’t need to prove wrongdoing or be separated before filing for divorce in Hawai‘i. Just say it’s “irretrievably broken,” and that’s enough.

6️⃣ Pets = Property (Legally 😬) – The law still sees pets as property, not family. So pet “custody” is more about ownership than their best interests.
