Tuesday Tip: What is probate, really?

If you've ever heard someone say "we're stuck in probate" and nodded like you knew what they meant — you're not alone. Here's the plain-English version.

Probate is the legal process of settling someone's estate after they pass away. A court oversees things like:
• Validating the will (if there is one)
• Paying off debts and final bills
• Distributing what's left to the right people

It's not always a nightmare — but in Ohio it can be slow, public, and more expensive than families expect. Especially if there's no plan in place, or if family members disagree on things.

Good news: a lot of probate stress is avoidable with a little planning up front.
Trusts, beneficiary designations, and clear documents can dramatically shrink what has to go through court — or skip it entirely.

Tuesday Tip: What a will actually does (and doesn't do).
A will is basically a letter to the future — one that a court will actually listen to.
What it does:
• Names a guardian for your minor kids
• Directs who receives your stuff (the house, the savings, grandma's ring)
• Names an executor — the person you trust to carry it all out
• Can set up basic trusts for kids so they don't inherit a lump sum at 18 (yikes)

What it doesn't do:
• Avoid probate (that's a common mix-up — wills go through probate, not around it)
• Cover retirement accounts or life insurance with named beneficiaries
• Take effect while you're still alive — that's what powers of attorney are for

A good estate plan usually layers a few tools together, and the right mix depends entirely on your family and goals. That's what a free consultation is really for — figuring out what you actually need, not selling you a stack of documents.
