Under California fair housing laws, Source of Income is a protected class. Housing providers cannot discriminate against any person using a government assistance program that provides rental assistance, security deposit assistance, or a housing subsidy such as HUD’s Section 8 voucher program.

C.A.R.’s new Legal Quick Guide, “Use of Section 8 Vouchers in Rentals,” explains how to handle Section 8 inquiries, evaluate applications with a rental assistance element, and use other best practices when interacting with tenants in rental assistance programs.

C.A.R.’s April Sales and Price Report is here to help you showcase your expertise and demonstrate your REALTOR® value.

In April, the California median home price reached a record high as the housing market picked up steam. Existing, single-family home sales totaled 275,580 in April on a seasonally adjusted basis, up 3.9 % from 265,320 in March and up 4.1% from 264,810 in April 2025. The statewide median home price set a record high, rising 2.9% from $889,190 in March to $914,810 in April and up 0.4% from $911,400 in April 2025.

On April 24, the U.S. Department of Housing and Urban Development (HUD) issued a “Dear Colleague” letter to HUD-funded fair housing organizations and real estate professionals clarifying that sharing objective information about neighborhood crime rates and school quality with prospective buyers is not a violation of the Fair Housing Act.

The National Association of REALTORS® (NAR) agrees that consumers seeking information about neighborhood schools and crime should have access to accurate and complete data during their home search.

Consistent with this position, NAR’s Code of Ethics and Standards of Practice explicitly allow members to share neighborhood demographic information, as long as it is not racial, ethnic, or religious.

Since the 1980s, NAR guidance has encouraged members to share objective, factual information about schools and crime, provided by a reliable third-party source.

At the same time, NAR has advised caution on how these topics are discussed. Subjective commentary, personal opinions, or hearsay about schools or crime have been cited as evidence of discriminatory intent and intentional steering in numerous fair housing legal cases.
