So how can a business name be trademarked in Florida, and should they file with the Florida state or USPTO?
There is no right or wrong answer to this question but it will relate a lot to what kind of protection your business requires.
A Florida state trademark registration will normally give protection in Florida. A federally registered trademark with the USPTO can grant you trademark rights in all the United States for the goods or services that you are federally registering.
If the business is only in Florida, then state registration may be a consideration. However, if you're selling online, you're serving customers across state lines, you're creating an e-commerce business or you're thinking about expanding to the national market, federal trademark registration may provide much greater protection.
An important step before filing a trademark application is a trademark search.
An adequate clearance search can help you determine if there are existing or pending trademarks that might cause problems before you invest more time and money into your business name, branding, website, packaging, advertising or expansion.
In Florida, the issue is not just:
Where do you do your business?
It's also:
“Where should I take this brand?”
