Incredibly proud to fight for another Montana Supreme Court win for our clients—this one for Zayne Hert. Zayne was deprived of his constitutional right to participate in high school sports during his senior year by the Montana High School Association. The MHSA created no record of its decision, denied that Zayne had constitutional rights, and denied that Zayne could seek judicial review. It was shameful. And when the district court ruled against Zayne, we knew that the MT Supreme Court would get it right on appeal. Upon review, the MT Supreme Court overwhelming agreed with us in a unanimous opinion. This case will both vindicate Zayne’s rights and ensure that the MHSA will create a meaningful record of its decisions affecting Montana students’ constitutional rights in the future.

This weekend, Passamani & LeTang’s Montana Supreme Court case in In the Matter of the Estate of Brockbank was discussed in the Wall Street Journal’s Personal Finance section. Much of the current law on Will recognition across this nation is not well equipped to address electronic wills. States are moving to adopt laws, including potentially Montana this legislative session.

Our client Levi returned from active service overseas in 2022 to find that he had lost rights at his place of employment. Federal USERRA law does not allow our brave service members to lose employments rights and privileges due to time in active service. Yesterday, a resolution was reached in a judicial mediation at the federal courthouse in Butte, America. Thank you for your service and also for being our client, Levi!

The best compliment we can receive after our presentations to the Montana Bar is that our content and analysis was useful to fellow Montana attorneys :) During the forthcoming legislative session, we will be reaching out to our representatives to introduce law in the estate planning realm that benefits all Montanans—including legislation related to Transfer on Death Deeds and the allowance of electronic wills in Montana. We will succeed on both.
