Confidentiality is a non-negotiable core value for every person in a law firm, not just the attorneys.

If you're focused only on training lawyers, you're missing a critical vulnerability. Nonlawyer staff, from assistants to IT personnel, frequently operate at the intersection of the firm’s most sensitive data.

Two critical risks to address now:

Misconceptions: The belief that "everyone knows" something or that public awareness voids confidentiality is false and dangerous. Confidentiality persists regardless of public knowledge.

Modern Technology (AI): Information shared with AI tools can be stored and reused outside the firm, risking inadvertent disclosure. Apply the “elevator test”: If you wouldn’t speak it aloud in a crowded elevator, don't enter it into an unapproved AI tool.

The key to safeguarding client trust is cultivating a shared ethical culture across the entire firm. This requires ongoing education, clear policies on AI usage, and reinforcing that ethics are integral to all staff roles.

Sometimes an email can make your day. This one made my week and my month:

"Dan, my name is B.C. You handled my late wife's successful Social Sec. disability claim back in 1991, 35 years ago. (that is, if you are the same ATTY. who worked at G&C back then). If so, we never forgot how satisfied we were with your excellent service. You were professional, honest, fair and caring! Her name was P.C. While recently going through old materials I found the original paperwork from our first to last correspondence with you.

"As good as you were back then, we were pleasantly surprised/shocked when our bill for your services arrived and the total charge was only $274.98. !! Unbelievable then, and still Unbelievable now.

"Thank you Dan. You have never been forgotten."

One of the reasons I opened my own firm 21 years ago was to help people. This email reminded of just how important every client is and always will be.

As AI transforms the legal landscape, understanding its ethical implications is crucial for attorneys. As Daniel J. Siegel recently noted in The Legal Intelligencer, lawyers who rely on AI-generated content without careful review and verification place themselves, their clients, and their licenses at risk. Missteps can lead to serious disciplinary actions. Our firm offers comprehensive AI governance, techno-ethics counseling, and tailored training programs to ensure compliance and protect your reputation.

We’re proud to announce a major victory for independent pharmacies, healthcare providers, and patients across Pennsylvania.

Daniel J. Siegel and Christa Frank High secured a Pennsylvania Supreme Court victory for 700 Pharmacy clarifying that the Workers’ Compensation Anti‑Referral Provision does not bar physician referrals for prescription drugs to pharmacies in which they have a financial interest.

The ruling preserves continuity of care by allowing injured workers to receive medications from providers who know their histories and treatment plans.

This ruling affects thousands of workers’ compensation claims and provides important clarity for patients, pharmacies, providers, insurers, and employers statewide.

Want to know why you can’t rely on a Generative AI citation without independently verifying it?

Here’s a real-world example.

Instead of going directly to a trusted legal research source, I posed a question to ChatGPT. It confidently provided a case citation. When I tried to locate the case, it didn’t exist. I flagged that. ChatGPT then doubled down—telling me the case was real, but explaining that it didn’t stand for the proposition I was given.

That’s the problem.

These systems are designed to produce plausible answers, not guaranteed accurate ones. In legal work—where precision matters—“plausible” is not good enough.

The takeaway is simple:
Never rely on a generative AI citation without independently verifying it through a reliable source.

In other words, treat AI as a starting point—not authority.😀😀

IMPORTANT LEGAL UPDATE: PENNSYLVANIA SUPREME COURT DECISION ON WORKERS' COMPENSATION NOTICE REQUIREMENTS

In a landmark decision, the Pennsylvania Supreme Court has ruled that under Section 311 of the Workers’ Compensation Act, an injured claimant who is the sole owner and employee of a business is not required to notify their workers’ compensation insurer of a work-related injury within 120 days to be eligible for compensation. Daniel J. Siegel and Christa Frank High of the Law Offices of Daniel J. Siegel, LLC were appellate counsel. Kenneth Spivack of Spivack and Spivack handles the underlying case.

The Court clarified that the term "employer" in Section 311 refers to the definition provided in Section 103 of the Act, which does not include insurers. This decision overturns the Commonwealth Court’s prior ruling and emphasizes that sole proprietors are not subject to forfeiture of benefits for failing to notify their insurer within the 120-day timeframe.

This ruling reinforces the importance of adhering to the plain language of statutory provisions and leaves any potential changes to the legislature. This decision is a significant win for sole proprietors in Pennsylvania, ensuring their rights to workers' compensation benefits are protected.
