Here are two lessons to be learned from this:
1) If you are not 100% about something in your past (criminal history, mental health treatment, etc.) it is a TERRIBLE idea to try to purchase a firearm. As described in the article, people are often charged with a felony after they are denied. Every day we perform Fi****ms Eligibility Investigations for clients BEFORE they learn the hard way, so they don't make that mistake! If you have already been denied, you need to plan for criminal prosecution immediately. I couldn't tell you how many criminal cases Attorney Richard Roberts and I have defended in this context (it is a lot), some through felony jury trial.
2) The article does not detail all of the FALSE denials that are issued. We also routinely help clients overturn PICS checks that are erroneously denied or "undetermined." If you were denied beware that you only have 30 days to file a challenge. We have to act FAST to gather records and determine whether a challenge is feasible/advisable.
