If law enforcement comes to your home, stay calm and ask whether they have a warrant.

If they do not have a warrant, you generally do not have to consent to a search. You can clearly and respectfully say:

“I do not consent to a search.”

Do not argue, resist, or attempt to physically stop an officer. If officers enter or conduct a search anyway, remember what happened and contact an attorney as soon as possible.

Knowing your rights does not mean being confrontational. It means protecting yourself while remaining calm.

Mental health does not automatically excuse criminal behavior, but it may provide important context in a criminal case, particularly when sentencing is involved.

That context must be supported by credible evidence.

Clinical evaluations, treatment records, hospitalizations, medication history, school records, trauma history, and testimony from qualified professionals or other supporting witnesses may all help create a more complete picture.

A diagnosis alone does not tell the whole story. A carefully developed mental health mitigation record can help the court understand how a documented condition affected the individual and why appropriate treatment may matter moving forward.

“They said they just want to ask me a few questions.”

That can sound harmless, especially when you haven't been arrested or formally charged with anything.

But being asked to speak with law enforcement and being under arrest are two different things.

If investigators believe you may have information about a crime, what you say during an interview can potentially become important later. Trying to explain yourself, clear something up or “just cooperate” doesn't necessarily mean the conversation is without consequences.

You can ask whether you are free to leave. You can ask whether you are being detained. And you can tell law enforcement that you want to speak with an attorney before answering questions.

You don't have to wait until you're sitting in a courtroom to start thinking about your rights.
