Under Mississippi law (Miss. Code Ann. Section 63-11-30), handling a first-offense DUI through non-adjudication offers eligible individuals a crucial statutory path to avoid a permanent criminal conviction. To qualify, a defendant must be a true first-time offender who did not refuse chemical testing, did not hold a commercial driver's license at the time of the stop, and must formally petition the court for non-adjudication at the time of the plea.

The statutory mechanics of the program require strict compliance with specific conditions imposed by the court. Defendants must pay all standard court fines, assessments, and required fees, while also successfully completing the Mississippi Alcohol Safety Education Program (MASEP). Additionally, participants are mandated to install an Ignition Interlock Device (IID) and maintain an interlock-restricted driver's license for a designated statutory period.

Successfully fulfilling every mandated requirement leads the court to withhold a formal judgment of guilt and eventually dismiss the charge. This outcome ensures that a formal DUI conviction does not enter the individual's criminal record, protecting them from long-term collateral consequences such as professional licensing hurdles and severe insurance rate spikes.

Because non-adjudication is a strict one-time privilege available only once in a lifetime under Mississippi law, failing to complete any single requirement will cause the court to revoke the agreement. Upon revocation, the court immediately enters a standard guilty verdict, revokes driving privileges, and enforces full mandatory sentencing penalties.
