💫 Big changes are coming to child custody law in Mississippi beginning July 1, 2026.

House Bill 1662 created a legal presumption that equal parenting time and joint custody are in a child’s best interest in most custody cases.

What does that mean?

For custody cases filed after July 1:
• Mississippi courts will begin with the assumption that children benefit from having substantial, equal involvement with both parents.
• Judges may still order a different arrangement when appropriate, but the Court must have evidence supporting why equal parenting time is not in the child’s best interest.
• The law does NOT automatically guarantee “50/50 custody” in every case. Factors such as abuse, neglect, domestic violence, substance abuse, distance between homes, work schedules, and the child’s specific needs will still matter.
• Child support calculations will look different in cases involving equal parenting time.

This is one of the most significant changes to Mississippi family law in years.

⚖️ PLG advice: Expect to share equal custody with the other parent. Do everything you can to work on the co-parenting in relationship BEFORE you are involved in a custody case.
