⚖️🏢 What Does It Take to Prove a Premises Liability Case?
Getting injured on someone else’s property doesn’t automatically mean the property owner is legally responsible. In Georgia, there are several things that generally need to be established in a premises liability case.

1️⃣ A Duty of Care
The property owner or another responsible party owed you a duty to keep the property reasonably safe.

2️⃣ A Dangerous Condition
There was an unsafe or hazardous condition on the property.

3️⃣ Notice
The responsible party knew—or should have known—about the dangerous condition and had an opportunity to address it.

4️⃣ Causation
The dangerous condition caused your injury.

5️⃣ Damages
You suffered actual damages as a result, such as medical expenses, lost wages, or pain and suffering.

📸 Evidence can be critical. Photos and videos of the hazard, witness information, surveillance footage, and medical records can all help establish what happened.

Every premises liability case is different, and the specific facts matter.

When you hear “premises liability,” you might immediately think of a slip and fall. But these cases can involve much more.

Some common examples include:

🛒 Slip, Trip & Fall Accidents — Spills, uneven surfaces, damaged flooring, or other hazards.

🐕 Dog Bites & Attacks — Injuries caused by a dangerous or uncontrolled animal.

🏊 Swimming Pool Accidents — Injuries or drownings involving unsafe pool conditions.

🪜 Unsafe Stairs & Railings — Falls caused by defective, missing, or poorly maintained stairs or handrails.

💡 Inadequate Lighting — Poorly lit areas that contribute to a fall, collision, or other injury.

🚗 Parking Lot & Garage Injuries — Dangerous conditions in parking areas, walkways, or garages.

🏨 Hotel, Restaurant & Retail Injuries — Unsafe conditions at businesses and other places open to the public.

The common thread? Someone was injured because of a condition on property they were visiting.

Premises liability is a type of personal injury law that deals with injuries that happen because of unsafe conditions on someone else’s property.

In Georgia, property owners and others responsible for a property have a responsibility to take reasonable steps to keep their property safe for visitors.

If you’re injured because a property wasn’t reasonably safe, premises liability law may give you the right to seek compensation for your injuries.

And it can apply to much more than just a slip and fall. Your home, a business, an apartment complex, a parking lot, or other property can all potentially be involved.

Simply put: Premises liability asks, “Who is responsible when unsafe property conditions cause someone to get hurt?” ⚖️

🤔🚗 What's your take? Who's responsible when the car is driving itself?
We’ve been talking about the $243 million Tesla verdict involving Autopilot—but that’s not the only lawsuit raising questions about responsibility and automated driving.

In June, the family of 76-year-old Martha Avila filed a wrongful-death lawsuit against Tesla after a Model 3 crashed into their Texas home. The lawsuit names both Tesla and the driver and alleges that Tesla's automated driving technology contributed to the crash.

So here's the question we want YOU to weigh in on:
⚖️ Where is the line of responsibility?

If a driver is using automated driving technology and something goes wrong, who should be responsible?
👤 The driver?
🚗 The manufacturer?
💻 The technology?
⚖️ More than one party?

As more of these lawsuits make their way through the courts, there may not be an easy answer.

🚗🤖 You saw it in the news! Now what does it mean for you?
A Tesla crash recently made headlines after a jury found Tesla 33% responsible for a 2019 fatal crash involving its Autopilot system. The case resulted in a $243 million verdict—and Tesla is appealing.

So what does this have to do with personal injury law?

⚖️ Who is at fault when a “self-driving” car crashes? That's becoming a complicated question. Traditionally, determining fault in a car accident means looking at the drivers: Who was negligent? Who caused the crash?

But what happens when the vehicle itself is making decisions?

A crash involving automated driving technology could potentially raise questions about the responsibility of:
👤 The driver — Were they paying attention and following the system's requirements?
🚗 The manufacturer — Was the vehicle or its technology defective?
💻 The software — Did the automated system make an unsafe decision?
⚠️ Warnings & instructions — Did the manufacturer adequately explain the system's limitations?

And here's the important part: fault doesn't necessarily have to belong to just one party. Multiple parties may potentially share responsibility for an injury.

That's why cases involving automated driving technology could have major implications for personal injury law. As cars become more automated, the question of “Who caused the crash?” may become much more complicated.
