This administration wants to target anyone who is an immigrant, helping an immigrant, associated with immigrant rights groups, and lawyers now too. Although I agree that those attorneys who are engaging in legal malpractice and fraud should be punished, it seems that this administration wants to instill fear in anyone who is involved with representing immigrants by the continuous attacks they make against us. We must stand strong in the face of adversity. The fight for justice can’t come to an end. ✊🏽

Sé que muchas personas hoy sienten miedo e incertidumbre después de leer sobre este nuevo memorando de USCIS en redes sociales y las noticias. Pero primero: respiren. 🤍

Este memorando NO significa una negación automática de un caso de Ajuste de Estatus.

Sí, el gobierno está enfatizando más el uso de la discreción en estos casos. Y sí, esto podría significar más escrutinio por parte de los oficiales de inmigración. Pero eso NO quiere decir que las personas con casos pendientes deban perder la esperanza o asumir que todo está perdido.

Ahora más que nunca, los factores positivos son extremadamente importantes al momento de convencer a un oficial de ejercer discreción favorable. Factores como:
• lazos familiares
• buen carácter moral
• historial laboral
• participación en la comunidad
• tiempo viviendo en EE.UU.
• dificultades extremas

Todo esto puede hacer una diferencia importante en un caso.

También es importante entender que para muchas personas, el proceso consular NO es una alternativa sencilla. Algunas personas provienen de países afectados por restricciones de viaje, y otras podrían activar castigos de 3 o 10 años al salir del país después de haber acumulado presencia ilegal.

Por eso cada caso debe analizarse individualmente y estratégicamente.

No permitan que el miedo o la desinformación en redes sociales los hagan rendirse. Manténganse informados y busquen orientación legal confiable. 💜
