In ex*****on of a Deed of Trust dated April 17, 2008, recorded in the Clerk’s Office of the Circuit Court of Rockingham County, Virginia (the “Clerk’s Office”), in Deed Book 3304, at page 452, amended by a Deed of Trust Modification Agreement dated April 15, 2013, recorded in the Clerk’s Office in Deed Book 4277, at page 59, and further amended by a Deed of Trust Modification Agreement dated April 9, 2018, and recorded in the Clerk’s Office in Deed Book 5002, at page 413 (as amended, the “Deed of Trust”), the Trustee will offer for sale at public auction the real estate described below. The public auction will be held at the south steps of the Rockingham County Circuit Courthouse, 80 Court Square, Harrisonburg, Virginia, on

August 18, 2022, at 11:30 a.m.

Tax Map Number 8-(A)-L26. All that certain lot or parcel of land, containing 2.464 acres, more or less, with improvements, together with all rights, privileges, appurtenances, easements and rights of way thereunto belonging or in anywise appertaining, situate approximately 435 feet north of Criders Road (State Route #865), in the Criders area of Plains District, Rockingham County, Virginia, being more particularly described according to a plat of survey made by Robert F. Jellum, C.L.S., dated July 13, 2007, which plat, together with a metes and bounds description is recorded with a deed recorded in the Clerk’s Office in Deed Book 3234, at page 388, being the same property acquired by Helen E. Cole by deed dated April 15, 2008, from David W. Knupp and Debbie W. Knupp, husband and wife, which deed is recorded in the Clerk’s Office in Deed Book 3304, at page 449.

Terms: The winning bidder must deliver to the Trustee a bidder’s deposit equal to the lesser of 10% of the sale price or $7,500 by either cash or cashier’s check payable to “Jordan K. Bowman, Trustee” which deposit may be waived or adjusted by the Trustee. The successful bidder shall pay the balance of the purchase price within 30 days after the sale date, TIME BEING OF THE ESSENCE. The Trustee reserves the right to verify that each bidder is capable of making the bidder’s deposit before the bidding begins. If purchaser defaults, the deposit shall be forfeited and applied to the costs and expenses of sale and the Trustee’s compensation as authorized by the Deed of Trust and law. Risk of loss or damage to the Property shall be borne by purchaser from the time of the Trustee’s strike down at the sale.

No representations or warranties of any kind whatsoever are or will be made as to any matter relating to the property, and the property will be sold “AS IS,” “WITH ALL FAULTS.” Conveyance shall be with Special Warranty and shall be subject to all recorded and unrecorded liens, encumbrances, security interests, easements, rights-of-way, covenants, conditions, restrictions and leases, to the extent any of the foregoing may lawfully apply to the Property or any part thereof and take priority over the lien of the Deed of Trust.

Purchaser shall pay all settlement fees, title examination charges (if any), title insurance premiums (if any), and recording costs including the grantor recording tax. Real estate taxes and other public charges will be prorated from the date of sale. Purchaser shall have the sole responsibility of obtaining possession of the Property. The Trustee reserves the right to reject all bids and withdraw the Property from sale, waive the deposit requirements in whole or in part and extend the period of time in which the purchaser must make full settlement. Additional terms of sale may be announced at the sale.
