The Pennsylvania Superior Court ruled that real estate agents are not liable for undisclosed property defects based solely upon a real estate agent's familiarity with a neighborhood. Plaintiff must prove actual knowledge, and an averment of "should have known" is legally insufficient.

The court also held that the Real Estate Seller Disclosure Law's two-year filing period runs from the date of settlement and operates as a statute of repose that cannot be extended through the discovery rule. A plaintiff/buyer cannot rely on the seller's disclosure statement to support alternative claims after the 2-year period expired when the agreement of sale contains an integration clause and does not incorporate the disclosure statement.
