Child Custody Modification Factors
Courts won’t modify child custody based on small changes in your life, but when the changes are substantial the courts will seriously consider your request for modification. In the eyes of the courts, the following are substantial changes:
• A parent moves a great distance away or out-of-state
• One or both parents remarry
• Your child experiences extreme health issues
• A parent fails to provide the child with proper daily care or supervision
• One parent alienates the child from the other parent
• Extreme moral misconduct makes a parent unfit
• A parent is convicted of a crime
• A parent seriously abuses or neglects the child
• A parent becomes involved in drug or alcohol abuse
• Domestic violence becomes an issue
Some of these circumstances are left to interpretation, but a qualified attorney can guide you through the process with an efficient legal protocols. While you can pursue a modification without an attorney, that pursuit may not yield you the best results. Contact me today for a free consultation!
