Child Custody Modification Factors

Courts won’t modify child custody based on small changes in your life, but when the changes are substantial the courts will seriously consider your request for modification. In the eyes of the courts, the following are substantial changes:

• A parent moves a great distance away or out-of-state
• One or both parents remarry
• Your child experiences extreme health issues
• A parent fails to provide the child with proper daily care or supervision
• One parent alienates the child from the other parent
• Extreme moral misconduct makes a parent unfit
• A parent is convicted of a crime
• A parent seriously abuses or neglects the child
• A parent becomes involved in drug or alcohol abuse
• Domestic violence becomes an issue

Virtual Meetings- how to keep the train on the tracks!

The best 5 tips that I have found for keeping your team focused and involved:

1. Establish a place where meeting ideas and agenda items are shared by your team weekly- each team member has their own issues that need attention, and ignoring them means important tasks are left incomplete, poorly executed, or ignored completely.

2. Share the final draft of the meeting agenda- 3 hours prior to your meeting close the brainstorming session and assemble the agenda to be disbursed to all participants. This is sometimes referred to as the "pre-read" to prepare for the meeting to ensure a seamless transition between topics.

3. Time restrictions- ensure that you allot a time period for each topic, as well as a speaker to introduce the topic and highlight key discussion points. If more time is needed for the topic it can be addressed in a group followup email AFTER the meeting.

4. Meeting recorder- pick a person each meeting that is not a designated presenter to take notes & create a post-meeting action items list to be disbursed to all participants. This creates deadlines and accountability so nothing important slips through the cracks.

5. Conduct a review- this can be done via email to evaluate meeting effectiveness!

**CHILD SUPPORT**

Texas law requires non-custodial parents to provide child support to the custodial parent, and the state has guidelines for calculating those payment amounts. A SIMPLE explanation of how to calculate your probable child support is:

Net income X %

The percentage is based on the number of children being supported. For example, the percentage for supporting one child is 20%, for two children 25%, for three children 30% and it continues on to include all children before the court.

Net income is your gross income minus federal income taxes, Social Security taxes, union dues and health insurance premiums you pay for your child.

Calculating child support sounds simple enough, but to avoid problems, you’re better off having a legal professional help you with it.

Expectation: Mediation with a person that won't communicate with me is a waste of time.
Reality: A mediator's job is to facilitate communication. While you and the other party may not be able to agree on anything, a mediator can often help you find common grounds. A mediator can also act as buffer and help diffuse arguments over your biggest issues. Sometimes hearing the other side of the story can help you see the issues from a different perspective and find a way to compromise. In many mediations the parties never even lay eyes on one another, let alone speak to each other, but you each get the opportunity to speak your piece and be heard. Yes, it's possible that you won't reach an agreement with the other party, but mediation is an opportunity to spotlight the issues and begin working towards resolution...and it's less expensive than going to court.

I have a misdemeanor charge pending against me, what is the worst that can happen?

Misdemeanors are broken down to 3 classes, so your possible punishment could vary.

A- Up to 1 year in county jail and an optional $4,000 max fine
B- Up to 180 days in county jail and an optional $2,000 max fine
C- Up to a $500 fine

If you have been charged with a Class A or B misdemeanor, the optional fines may be imposed in addition to or as an alternative to jail, and if certain conditions are met, a county jail sentence may be served by participating in an electronic-monitoring program.

Is it legal to drink alcohol while driving an automobile? What about having an open container in the vehicle?

It is a Class C Misdemeanor for a driver to have an open container of alcohol in his or her personal possession while operating a motor vehicle. It is also illegal for any passenger to have an open container of alcohol in their possession. However, if you are the passenger in a taxicab, limousine, bus, or in the living quarters of a mobile home, you can legally consume alcohol while being driven around.
If you go to a party and take a bottle of wine, beer or liquor, and leave the party with them you can be ticketed for possessing an open container of alcohol. In order to legitimately carry a bottle of wine, beer or liquor, the seal must not be broken. If the seal is broken, the only other legitimate way to carry the bottle is put in the trunk of your car, or if you are in a truck or SUV, then it must go behind the last row of seats. However, my advice is to leave the alcohol at the party when you leave.

How Texas courts make custody decisions based on what is "in the best interest" of the child. The Judge will hear the parents' desires, and if the child is over 12 the Judge will hear the desires of the child. Some of the factors the court examines are:

• Your child’s physical and emotional needs
• Each parent’s ability to meet the child’s needs
• How to best maintain the child’s stability (staying in the home, attending the same school, etc.)
• Each parent’s willingness to support the child’s relationship with the other parent
• The child’s relationships with brothers or sisters and other family members
