This is one of those quiet ways our state still runs on a different operating system than the other forty nine. Because Louisiana law grew out of the French and Spanish civil codes instead of English common law, our notary is not a clerk. A Louisiana notary is a civil law officer, closer to the European notaire, a trained legal professional with sweeping authority baked into the office.
A commissioned Louisiana notary can draft and execute your last will and testament. They can pass an act of sale that transfers a house or a whole plantation of land. They can authenticate contracts, take affidavits, and create legal documents that carry the weight of authentic acts, meaning a court largely takes them as proven fact. In the old days, in the further reaches of the state, the parish notary was often the person who held a community's entire legal memory in their ledgers. 📜
