Attorney Gunnell will be speaking at Life & Legacy Day at Hanover Believers in Christ Church (301 Maple Avenue, Hanover) on Saturday, February 25. Attorney Gunnell will be addressing estate planning strategies. Other speakers include representatives from Cross Keys Village, Thrivent Financial Services, and Wetzel Funeral Home. The day runs from 9 a.m. until 3 p.m., with lunch included for a cost of $10.

We are pleased to announce that Attorney Ruth Crabbs Gunnell has been elected to the office of Secretary of the York County Bar Association. Attorney Gunnell has been a YCBA Board member since 2020.

She has also been active with the YCBA Estate Planning & Probate Section, Family Law Section, Orphans Court Rules Committee, Membership Committee, and Modest Means Program. For these and other contributions, Attorney Gunnell was also named the YCBA Outstanding Member of the Year for 2020.

The statewide suspension of residential evictions and ejectment actions has been extended to May 11, 2020, per the Pennsylvania Supreme Court's Order issued today. Therefore, as of that date, property owners and property management companies will again have the ability to pursue eviction actions against tenants for reason of nonpayment or other lease violations.

COVID-19 Update, 4/13/20:
Today the Family Court Division of the York County Court of Common Pleas issued a reminder that “[a]bsent a determination that a household member has been diagnosed with the virus and a determination of a risk of harm to the child, withholding custody is not reasonable.”
Otherwise, despite the current pandemic, custody Orders and Stipulations remain in effect. A party’s failure to comply with an Order may subject him or her to “severe sanctions.”

Another COVID-19 Update, 4/3/20:
The York County Court of Common Pleas has announced that beginning Monday, April 6, it will again accept custody filings and will be scheduling conciliations (by telephone) for those cases. These cases include new custody cases, as well as Petitions for Modification and some Petitions for Contempt.

Coronavirus update: The York County Register of Wills and Orphans Court Offices are addressing problems posed by social distancing requirements with video conferencing. Individuals (and their attorneys) can now video conference with Courthouse staff to probate Wills and apply for marriage licenses. There are a couple steps to do each, but the Courts are certainly doing what they can to accommodate these needs of the public during this pandemic.

We have had a number of clients contact us about custody concerns given the current Coronavirus pandemic and social distancing restrictions and limitations on allowable travel (in some counties).

This afternoon the following statement was issued by H. Geoffrey Moulton, Jr., Court Administrator, Administrative Office of Pennsylvania Courts:

"I have been asked about the impact of the Governor's 'stay at home' order on existing child custody orders and the travel necessary to effectuate them in affected counties. The Governor's Office of General Counsel has confirmed to me that the Governor's order does not prohibit such travel. (In counties not subject to the stay-at-home order, there is likewise no barrier to such travel and the continued enforcement of custody orders.) While you and your fellow judges have discretion to modify custody orders in light of changing circumstances, nothing in the Governor's order requires that you do so."

Therefore, current custody Orders remain in full force and effect unless and until a local Judge issues a direction to the contrary.
