Rideshare accidents are confusing by design. Multiple insurance policies, corporate liability shields, and a process built to make it hard to figure out who actually owes you.
What you need to know before talking to anyone's insurance:
✅ If the rideshare driver was at fault and the app was active, the company's commercial policy applies, typically up to $1 million in coverage
✅ If another driver caused the crash, your claim may go against that driver's insurance, but the rideshare company's policy can serve as backup if they're underinsured
✅ If the app was off, the driver's personal auto policy applies and coverage limits may be much lower
✅ As a passenger, you were not in control of anything. You have every right to file regardless of which driver was at fault
The confusion benefits the insurance companies, not you. The faster they can discourage you from filing, the less they pay.
