We have been fielding questions regarding Federal Stimulus Checks being sent to or Direct Deposited to deceased taxpayers. The short answer is that at this time, they must be returned to the IRS per the IRS.gov website. The philosophical answer is "If it seems too good to be true, it is." However, it would be prudent to wait a few weeks to make sure that the IRS doesn't reverse course and allow what has been sent to be kept. Once again, as we close out yet another year and reflect on the fresh, unspoiled New Year ahead, I would offer one of my favorite quotes by C.S. Lewis:
"You are never too old to set another goal or
dream a new dream."

What plans or goals did you have for 2015 that somehow were put off, set aside or just forgotten about? Resolve to make 2016 a year of accomplishing those personal planning goals that have been set aside long enough.

Many have asked my opinion concerning Ohio Ballot Issues 2 and 3 so I'll try to succinctly explain my thoughts:

Issue 2: Voting YES will PROHIBIT ballot issues that would amend (change or add to) Ohio's Constitution to allow a monopoly, cartel, a special interest group or a limited number of persons to be granted permanent preferential tax treatment or business opportunities UNLESS two votes are taken- the first to allow the special preferential treatment and the second to decide if the subject matter of the special treatment should be allowed anyway. The voters still retain the right to make the decision, it just makes it more difficult to accomplish. Granting special, preferential treatment to a limited number of people should not be granted lightly.
VOTE YES ON ISSUE 2.

Issue 3: "Medical Ma*****na" is the deceptive tool to authorize allowing pot to become just another common commodity to ingest without hassle which impairs driving, and many other daily life tasks. The legislature has the right to legislate medical ma*****na allowances if that is what the public wants. Issue 3 amends the Ohio Constitution to permit the following:
-Allow 1,100 retail locations across Ohio
-Grant the owners of 10 locations in Ohio the exclusive right to grow pot for commercial production. They are the exclusive, specially designated monopoly that will benefit from the commercial growing, sale and marketing of pot from the supply side of the specially carved out commercial treatment of this limited group of investors.
-Prohibit local zoning laws from excluding Pot Shops from any area except existing residentially zoned areas.
- Allow you (or your next door neighbor) to "grow your own" regardless of where you live.

And the list goes on...
VOTE NO ON ISSUE 3.

PLEASE educate yourself and don't just listen to what I or anyone else recommends to you. A Constitution is NOT a book of laws, it is a founding document of general principals of government, and a guarantee of the God- given rights of individuals (not monopolies) to keep government in check against tyranny of its people.

As we approach the winding down of 2015, resolve to finish the year by making sure your personal affairs are in order. Whether it's a tune-up or an overhaul, start the new year with confidence that you have made the choices that are consistent with your plans, and do not settle for however the chips fall. Will? Trust? Estate Plan? Transfer on Death (TOD)? Payable on Death (POD)? Beneficiary? Are you familiar with how any, some or all of these terms can impact the distribution of assets when the time comes?

Recently came across an interesting factoid- Approximately 55% of adult Americans do not have a basic will and the numbers jump to almost 70% of African-Americans and nearly 75% of Hispanic-Americans who are going to allow the state to determine the distribution of their assets. Is that your Estate Plan? Call for a consultation. YOU should be the one making these decisions, not the State of Ohio.
