This was signed into law today. In summary it will be more difficult for a court to order reunification therapy.

Based on the 2024-2025 legislative session, Assembly Bill No. A5761 (and its identical companion Senate Bill No. S4510) aims to reform procedures in contested child custody cases to prioritize child safety and welfare.
Key Aspects of the Bill (as amended in Dec 2025):
Restricts Coercive Therapy: Prohibits courts from ordering reunification therapy that uses force, coercion, or isolation, or that cuts off a child from a parent with whom they are bonded.
Seals Records: Requires that records of a child's private, in-chambers conversation with a family court judge be sealed.
Court Discretion & Documentation: Allows courts to modify ongoing therapy based on therapist reports but requires the reasons for such modifications to be placed on the record.
Legislative Intent: Amends the child custody statute to emphasize the "best interests of the child" and clarifies how courts should approach these cases.
Study and Funding: Appropriates $500,000 each to the Administrative Office of the Courts and the Institute for Families at the Rutgers School of Social Work to study the effectiveness of these new provisions.
