Preserving electronic records is critical when anticipating a lawsuit as it can make or break a case. Electronic records such as emails, text messages, social media posts, and electronic documents are frequently used as evidence in legal proceedings. Failing to preserve this data can result in significant legal consequences, including sanctions, adverse inferences, or even the loss of the case. Therefore, it's crucial to safeguard electronic records and data that may be relevant to a lawsuit by implementing a proper preservation process. This can help ensure that the evidence will be available and admissible when needed, giving you a better chance of a successful outcome.

Business litigation has become increasingly complex in recent years. As the business world becomes more connected and the volume of data involved in disputes increases, clients are finding that the costs of litigating can spiral out of control.

One way to keep costs under control is to engage in effective early case assessment and management. By thoroughly reviewing the facts and legal issues early on, clients can make informed decisions about which disputes to pursue and which to settle, and can develop a clear strategy for resolving the matter efficiently. Additionally, involving experienced business litigators in the process can help clients understand their rights and obligations, as well as the costs and benefits of different courses of action.
