Proud to have the opportunity to argue before the Appellate Division on an issue that could affect thousands of people across the State. My client and I were fortunate to be joined by the New Jersey State Bar Association, who appeared as amicus in the appeal, and were represented by Criminal Law Chair Michael Roberts. The ACDL-NJ and the New Jersey Attorney General also joined as amicus in support of our position that defendants who previously participated in a diversionary program to avoid convictions for possessing ma*****na should have their diversionary program-eligibility restored in light of the recent reforms to New Jersey's ma*****na laws.

Another quote, this time in Sunday's Star-Ledger. New Jersey's prohibition against adults possessing and using cannabis had racist roots both in the enactment of the law and in its enforcement. It would be absurd for the eligibility for diversionary programs to continue to be linked to whether the applicant had a prior brush with this outdated law.

As New Jersey wipes away ma*****na records, some say it should give people a second chance at first-time offender programs.

I’m not going to blame the media for possibly getting this wrong. We consumers demand that our news be supplied in real time. But we consumers need to remember that alleged crimes don’t always end up being what we thought they were.
