Self-Defense is a well established protection and guarantee, I appreciate as a lawyer and especially as a mother, supported by the US Constitution, State Constitutions, statutes, and case precedents set by our courts. Both personally and professionally I take comfort and find safety and security in those protections and guarantees. As a licensed, practicing attorney I also know, understand, and fully respect that our legal system effectively, although sometimes slowly, flows creating a system “scales of justice” which results in a check and balance protection keeping everyone and the authorities they operate under in “check”. I feel empathy for the police officers and prosecutors who carry the weight of investigating, recommending, and presenting a case, such as this, to a grand jury as they have not been given the authority to do otherwise. This is done because the grand jury empaneled to hear the evidence on this case are the initial determining authority and tasked with the responsibility, weight of and authority to issue an indictment for 1st degree murder. While I suspect, from experience not personal knowledge of any of these law enforcement officers or DA’s opinions, they do not believe he is guilty of first degree intentional homicide but they still have to uphold their oath to investigate and present to a grand jury nonetheless. Additionally, in the event a grand jury indicted this man for first degree murder a jury would be empaneled to apply the evidence and determine if he had justification (self-defense) to do so (during his trial) as they would apply the laws and evidence to make a decision on guilt or innocence, again providing a “check and balance” protection. This is why citizens empaneled to serve as a grand juror or on a jury at trial are so important and necessary. Generally speaking everyone hates jury duty and runs in the other direction but this is why the it is so important that you do. The authority and power given to Police Officers and District Attorneys ,”checked and balanced” by a grand jury of matching power and authority, represents giving the power back to the members of the community for which they serve to protect the power and task them with the authority to make the decision. This decision is protected, the jurors are protected and is the ultimate and final decision making authority. This process can seem unfair or seem unjust at times but NOT believe this man is going to be indicted or prosecuted for murder and after giving a bit of time for the system to “check and balance” itself will be evidenced. This is one of the reasons I hold so much respect for the justice system as it flawlessly exposes the truth from the lies. It is an impressive process to witness and participate in.
