The challenge of aging is making decisions affecting your health. As a conservator, I am charged with making these decisions for my clients to ensure their wellbeing. This week, my client was hospitalized because of an infected toe and I had to provide approval to amputate. As one might not see that as significant, when you are in a nursing home knowing that this is your last stop, it can feel overwhelming and the loss greater than just losing a toe. Praying for Miss Anne today.

Conservatorship vs. Guardianship: What's the Difference?
When an individual is in need of care to the extent that they become a ward of the court, the court will appoint a guardian or conservator to help. A guardian assumes responsibility for the basic care and daily needs of a child or of an individual who has been determined to be mentally or physically incapacitated, while a conservator is appointed when a minor or incapacitated adult is in need of an adult to manage their property and assets.
The duties of guardians and conservators can overlap, and sometimes the same person is appointed to both roles, but their roles are very different.

US pop star Britney Spears has called for an end to the "abusive" management of her business and personal affairs, telling an LA court: "I want my life back".
The singer's career has been in the hands of legal guardians in an arrangement known as a conservatorship since 2008 when she faced a public mental health crisis.
The court-ordered agreement gave her father, Jamie Spears, control over her estate and other aspects of her life.

Conservatorship and Guardianship
When someone is no longer able to handle his or her own financial or personal affairs, the court can appoint an individual or professional to act on behalf of the incapacitated person. When a minor child is involved, it is generally called a guardianship. When an adult needs someone, it is called a conservatorship. However, states define these terms differently, and you need to consult an attorney in your state to determine what the law are and how they impact your situation.

6 Steps to Take Before You Begin Divorce Mediation
Thinking about divorce mediation? Excellent idea if you and your spouse have the shared goal of uncoupling amicably (or at least are committed to working together to dissolve your marriage in a fair and cooperative way) but have too many issues to resolve them on your own. Working with a good mediator has its perks — most notably you can cut down on attorney fees and costs, go at your own pace, keep the intimate details of your life a lot more private, and work toward an agreement that meets both of your needs (instead of relying on the court model, which is more of a zero-sum game). If you have children together, you may even be able to save or evolve your relationship such that you can transition into a new type of arrangement. As Belgian relationship therapist and author Esther Perel says, “Divorce is not the end of a family; it’s a reorganization.”

Divorce Mediation: Three Secrets to Getting What You Really Want
When Kevin and Jessica entered divorce mediation, they both immediately demanded “school night” custody of their 7-year old daughter Lilly. It became such a stalemate that it looked likely the pair would need to go before a judge. As a last resort, the mediator took each aside and asked them privately to explain the real goal of their custody demands — what did Kevin and Jessica really want?

In order to get what you want through the mediation process, you need to develop a strategy in advance. You need to know your priorities, you need to know your spouse's priorities (at least to the extent that you can make educated guesses), and you need to know when it is time to compromise for the greater good.
