Kobe Bryant reportedly updated his trust several times throughout his life . . . but after the birth of one of his daughters, she was accidentally left out of the documents until a legal amendment was made.

Imagine building a legacy worth millions, and realizing one simple oversight could leave a child unprotected.

That’s the thing about estate planning:
Life changes.

Marriage.
Kids.
Grandkids.
Break-ups.
New homes, land, boats, toys.
New accounts.

And if your plan doesn’t keep up, the consequences can be very real.

Estate planning isn’t “one and done.”
Make sure your plan grows with your family.

What a wonderful evening at Piguets Prime Time last night. From turning off the main road and leisurely driving down the lovely gravel road between pastures arriving at the restaurant greeted warmly by Patti, meeting Ms. Carolyn and being served by Donna. A breath of elegance and perfection! The food was superb, the setting cowboy elegance. A location to pause, reflect, and breathe. God’s Glory shown throughout the buildings, the land, the people. A place to linger! Plus an acoustic guitarist! Rick you made our evening when we heard the first notes of Stairway To Heaven! Lovely. A perfect evening with my sweet husband at our new favorite place. 5 star all the way! Oh, and the food! Cowboy Candy! Spectacular. Everything bite was extraordinary. Thank you for this beautiful place to dine.

🎵 Today marks 10 years since the world lost a legend — and the legal battle that followed Prince's death became one of the most complicated estate cases in U.S. history.

Here's the hard truth: Prince — one of the most private, detail-oriented artists who ever lived — left behind NO will. No trust. No estate plan at all.

What happened next was a years-long legal nightmare:

⚖️ Nearly 30 parties came forward claiming to be his heirs
💰 His estate was valued at roughly $200 million, including a massive vault of unreleased music
🏦 A bank was appointed to manage his assets, leading to constant disputes with his family over his music catalog, Paisley Park, and more
📋 The IRS challenged the initial $82.3 million valuation, claiming it was undervalued by $80 million
😔 Two of his siblings passed away during the proceedings, adding even more complexity
🗓️ It took over SIX YEARS to reach a settlement — finally resolved in 2022

And even then, litigation over his estate continued into 2024.

All of this could have been avoided with a simple estate plan.

Prince gave the world so much — his genius, his artistry, his soul. He deserved to have his legacy protected and his wishes honored. So do the people you love.

At Muscari Law - Susan A. Muscari, we believe that estate planning is one of the most loving things you can do for your family. Whether you have a little or a lot — a home, a business, a music collection, or simply people you care about deeply — a will or trust ensures your wishes are honored, your family is protected, and your legacy is handled with the care it deserves.

Honor your life. Protect your people. 💜

💰 You can give $19,000 to any number of people each year with no tax and no paperwork. Five kids? That's $95,000 a year with zero tax consequences.

The part most people get wrong: gifts above $19,000 per person are not automatically taxed. They just count against your lifetime exemption. In 2026, that exemption is $15 million per individual. $30 million for a married couple.

If you give one child $100,000, the $81,000 above the annual limit reduces your lifetime exemption from $15 million to $14.919 million. You file IRS Form 709 to report it. You owe nothing.

Gift tax only kicks in after you've given away more than $15 million over your entire lifetime. For the vast majority of people, the actual tax bill is $0. The form is the only obligation.

One trap to watch: gifting appreciated property like a house. If you bought it for $50,000 and it's now worth $300,000, your kids inherit your $50,000 cost basis.

When they sell, they owe tax on the $250,000 gain. If they inherit the house after you pass instead, they get a step-up in basis to the current value and owe nothing on the gain.

These limits have changed before and may change again. The current $15 million exemption is historically high. It could be reduced in future legislation to generate government revenue.

📋 Beneficiary designations on retirement accounts, life insurance, and TOD/POD accounts override your will. The person named on the account receives the asset regardless of what your estate plan says.

This is the most common estate planning disconnect. Someone updates their will after a divorce but forgets to change the beneficiary on a 401(k). The ex-spouse may receive the full balance.

For ERISA-governed plans like a 401(k), federal law requires spousal consent to name a non-spouse beneficiary. For IRAs and life insurance, no such requirement exists, and the designation alone controls.

Employer group life insurance policies are the ones people forget most often. Many are set up during onboarding and never reviewed again.

HSAs have a specific tax rule. If the named beneficiary is a surviving spouse, the account transfers tax-free. If the beneficiary is anyone else, the full balance becomes taxable income in the year of death.

A beneficiary designation review takes less than an hour. Pull up every retirement account, insurance policy, and bank or brokerage account with a TOD or POD feature, and compare the names on file to your current plan.

The time to fix a mismatch is now, not after it matters.
