Named Executor of an Estate in Indiana? Here’s What to Know

Being named executor of a loved one’s estate can feel like an honor. It can also come with more responsibility than many people expect.

An executor, also called a personal representative in Indiana probate matters, may need to deal with estate property, creditors, financial accounts, court requirements, beneficiaries, real estate, and other issues before the estate can be properly distributed and closed.

Our latest article explains what an executor may be responsible for, what to consider before agreeing to serve, and why choosing the right person matters when creating your own estate plan.

If you’ve been named executor and aren’t sure what to do next, Vick Law helps families in Greenwood and surrounding communities understand the Indiana probate and estate administration process.

“I know we need to do it. We just haven’t gotten around to it yet.”

Estate planning is easy to put off because nothing feels urgent. Then an accident, illness, or death happens, and suddenly your family needs documents that were never created or a plan that hasn’t been updated in 15 years.

A good estate plan isn’t just who receives your property someday but answers important questions while you’re living.

Who can manage your finances if you can’t?

Who can make healthcare decisions?

Are your beneficiary designations still correct?

Does your old will still reflect your family today?

Our latest article explains why estate planning deserves to move off the “we’ll get to it eventually” list.

If you’re ready to understand your options and develop a plan that fits your family, contact Vick Law.

What Happens to Your Estate Plan After the First Spouse Dies?

You may want your spouse to be financially secure if you die first. However, have you considered what happens to those assets after your surviving spouse dies?

This can be an especially important question for second marriages and blended families. A surviving spouse may remarry, family relationships may change, and assets could eventually pass differently than originally intended.

A QTIP Trust is one estate planning strategy that may allow married couples to provide for a surviving spouse while maintaining greater control over where remaining trust assets ultimately go.

Our latest article explains how QTIP Trusts work, when they may be worth considering, and some of the trade-offs involved.

If you're married and wondering whether your current estate plan addresses what happens after both spouses are gone, contact Vick Law. We help families in Greenwood and surrounding communities understand their estate planning options and develop plans tailored to their circumstances.

Your parents are healthy and independent today. But what happens if that changes at 80, 85, or 90?

A fall, dementia diagnosis, hospitalization, or sudden decline can quickly leave families facing questions they never expected:

Who will provide the care?
Can Mom stay at home?
Will Medicare pay for it?
Could Medicaid help?
What happens to the house?
Who can legally make decisions if a parent becomes incapacitated?

As more Americans reach their 80s and 90s, these questions are going to become increasingly common. Our latest article looks at the coming elder care challenge and, more importantly, what families can do now to prepare before a crisis makes the decisions for them.

At Vick Law, we help Greenwood families understand how estate planning, elder law, and Medicaid planning can work together as part of a thoughtful long-term care plan.

What happens if your child inherits everything at 18? Or if you want to provide for your spouse, but also make sure your children from a previous marriage are part of the plan?

These are some of the reasons families consider trusts.

A trust can give you more control over how and when assets are managed and distributed, especially when family circumstances aren't simple. Our latest article explains what trusts can do, when they may be worth considering, and why creating the trust is only one part of the planning process.

Indiana has expanded property tax relief for disabled veterans. Could the new law affect your estate plan?

Qualifying totally disabled veterans may now be eligible for a deduction that reduces the assessed value of their primary residence to zero for property tax purposes. The changes generally affect taxes payable in 2027. There’s an important detail for veterans considering estate planning: a home held in a trust cannot receive the new 100% deduction. That makes it worth reviewing your options before transferring your home into a trust.

Our latest blog explains who may qualify, when a new application is required, what surviving spouses should know, and how the new rules may affect estate planning decisions.

Mom has dementia, but she refuses to sign a Power of Attorney. What can you do?

It’s a difficult situation for families. You may see unpaid bills, growing confusion, or decisions that put a parent at risk. You want to help, but being their adult child doesn’t automatically give you the legal authority to step in.

A dementia diagnosis doesn’t always mean it’s too late to plan. Your parent may still be able to make certain legal decisions, depending on their capacity. If they can no longer sign a valid Power of Attorney, your family may need to explore other options, including guardianship.

Our latest article answers common questions about dementia and Power of Attorney in Indiana, including what to do when a parent refuses help, how to review an existing document, and when court involvement may be necessary.

Have you been watching the new season of Leanne on Netflix?

My wife and I have been enjoying the show. It’s funny, but as an estate planning and elder law attorney, I couldn’t help noticing how naturally it captures something we see in our office all the time: adults caring for aging parents while still supporting their children and grandchildren...and still navigating their own personal life changes.

Retirement doesn’t always mean life slows down. Sometimes it means helping Mom get to appointments, worrying about Dad’s health, and realizing nobody knows where the Power of Attorney or healthcare documents are.

Our latest Vick Law article looks at what Leanne gets right about family responsibilities, the sandwich generation, and why having these conversations before a health crisis can make a difference.

If the show feels a little familiar, this article may be worth sharing with your family.

You worked hard to build what you have. What do you want it to mean?

For many women, estate planning eventually becomes about more than deciding who receives what. It becomes a conversation about family, financial independence, grandchildren, charitable giving, long-term care, and the kind of legacy you want to leave.

Maybe you want to help the next generation without simply handing over an inheritance. Maybe giving to your church or a cause you care about is important to you. Your first priority may even be making sure your own retirement and future care needs are thoughtfully planned for.

Our latest Vick Law article looks at estate planning and wealth through a woman's perspective, including how trusts, charitable giving, family conversations, and long-term planning can help turn the wealth you've built into a plan that reflects what matters to you. Your estate plan should reflect your life, not simply the value of your assets.
