This is where I see most divorce settlements go wrong.

The terms are negotiated.
The agreement is signed.
And everyone assumes the outcome will work.

But no one verified whether it could.

In divorce, there’s a critical gap between what is agreed to and what is actually executable—especially when it comes to mortgage financing.

Refinancing timelines, income qualification, debt allocation, and title structure are often treated as future steps instead of being evaluated before the settlement is finalized.

And when those assumptions don’t hold?

The result is an agreement that looks solid on paper—but creates real challenges in ex*****on.

This article breaks down why hypotheticals often turn into unworkable outcomes—and what’s missing from the conversation: https://bit.ly/3RlyZKB

If it can’t be executed, it wasn’t a strategy—it was a hypothetical.

As a Certified Divorce Lending Professional (CDLP®), I evaluate the feasibility of settlement outcomes before they’re finalized—so the structure actually works in the real world.

Could higher interest rates actually be creating an opportunity for homebuyers?✨
I know that sounds odd, but hear us out.

Affordability is top of mind for just about everyone right now. And frankly, I think buyers are getting tired of waiting for what they’ve been told might happen with interest rates.

But something else is happening in the housing market.

Higher interest rates are putting pressure on home
prices, and sellers who are motivated to move are having to get more realistic.

Whether it’s a job relocation, a divorce, or a growing family that’s simply outgrown their home, life doesn’t stop just because interest rates are higher.

And that’s creating opportunities for buyers.
We’re seeing opportunities for:
    •    More inventory and choices
    •    Price reductions
    •    Seller concessions to help with closing costs or buying down the interest rate
    •    More negotiating power than buyers have had in years
And here’s something important if you’re both selling AND buying.

Yes, you may have to be more realistic about the price of the home you’re selling. But you may also benefit from those same market conditions when you purchase your next home.

What you give up on one side of the transaction, you may gain on the other.

Here is the bottom line.
Pay attention to this market between now and the end of the year.

And when you are ready, give us a call! Let’s look at the numbers and help you make an informed decision.

This time of year reminds us that letting go is part of every season.

As a Certified Divorce Lending Professional (CDLP®), I often see decisions about the home being made before anyone has looked at what they will mean for the mortgage.

If you are going through a divorce, you are letting go of a lot right now. That deserves patience. What comes next deserves a plan.

Before you sign the settlement, find out how its terms will affect your ability to keep the house, refinance, or buy your next home. Getting those answers early gives you the chance to make choices with clear information rather than finding out after the agreement is final.

If you or someone you know is facing these decisions, I would be glad to talk through your situation.

You can’t negotiate a hypothetical—but that’s exactly what happens in most divorces.

The house becomes the focal point.
Emotions take over.
Decisions get made based on what feels right—not what qualifies.

Here’s the problem:
A court can award a home.
Only a lender can approve a mortgage.

If the financial structure doesn’t align with lending guidelines, the agreement can fail after it’s signed.

That’s not a legal issue. It’s a planning gap.

As a Certified Divorce Lending Professional (CDLP®), I help bring clarity to what’s actually possible—before decisions are finalized.

I know this sounds odd, but hear me out.

Higher interest rates can be a bigger problem for sellers than for buyers.

Why? Because buyers qualify based on what they can afford each month. When rates rise, the same payment buys less house, putting pressure on sellers to lower their prices.

And when inventory grows, buyers have more choices. Sellers who are highly motivated and really need to move may have to make bigger price reductions to compete.

For buyers, that can create opportunities to negotiate a lower price or ask for seller concessions.

But what if you’re selling AND buying?

You may get less for your current home, but you may also pay less for your next one. It becomes a wash.

BUT, if you’re able to buy your next home while keeping your current home as a rental, that’s another strategy worth exploring. Rental income could help cover the mortgage while you hold the property and potentially sell later if values improve.

The point? Higher rates don’t automatically mean you should put your plans on hold.

Whether you’re buying, selling, or doing both, let’s look at the numbers and see what makes sense for you and watch as these home prices come down!

This issue of Divorce Mortgage Insights takes on a question that comes up whenever one spouse keeps the house: who pays for repairs on the marital home?

The article makes a practical point. The settlement agreement is usually signed months before the lender orders its appraisal. If that appraisal lists work the lender requires before closing, and the agreement never said who covers it, the refinance waits while the spouses negotiate after the fact.

It explains how known issues can be handled: an adjusted value, a credit against the buyout, completing the work before the transfer, or a written acknowledgment of condition. It also shows how an agreement can account for problems nobody has found yet, with a trigger, a cost source, a split, a cap, and a plan for the deadline.

If you are an attorney or mediator working on a settlement where the home is staying with one spouse, I am glad to talk through how the refinance side may affect the terms.
