We have been discussing the importance of wills recently. Here are some legitimate reasons to seriously consider preparing a will today:

* avoids years of litigation for your family
* helps to settle family disputes
* allows you to dictate what you want to give and to who
* you name a guardian for your children
* saves your heirs time & money

These are all very important reasons to have a will completed as soon as possible. If something happens to you and you die intestate (without a will) problems can occur leaving your family in legal limbo.

Wills are important to those that matter to you. They are a selfless thing you can do to protect the ones you love. A will helps to avoid conflict and legal problems for your heirs.

Providing awareness about the importance of a will is something our estate and tax law office feels strongly about.

According to this 2021 Gallup poll https://news.gallup.com/poll/351500/how-many-americans-have-will.aspx only 46% of U.S. Adults have a will. You can also scroll through and see the percentages by age, income, and more. The numbers given are pretty interesting.

Starting a will is the hardest part. It may be difficult to put aside the thought of your own mortality and really focus on how and what you want to leave your loved ones. However, having a legal will in place is critical for those you love.

An easy way to start is online. There are a variety of DIY online sources that offer template forms to get started. They are inexpensive and quick. It’s better than not having a will at all.

In many situations though, these may not cover every aspect of your wishes in your will. Online wills fail to offer tax guidance, the language may be inadequate, and the standard forms are not typically customizable. There may be additional legal issues that are too long to list within a post here.

If that is the case for you, contact a trusted estate attorney for a review of your online will and the necessary legal guidance.

The bottom line is start preparing a will today. Whether it is online or through your attorney the best course of action is to avoid procrastination when it comes to drafting a will. We never know when our time is up.

Have you thought about what happens if you die without a will (intestate) or what happens to your children and belongings? Thinking about our own demise is difficult, we understand this. Estate planning is a deeply personal situation. Regardless we should all be prepared.

None of us are immortal. None of us can take our money, property, and other important belongings with us.

Most parents want to know their children are taken care of also. Even if you only have a few hundred, or a few hundred thousand dollars in your bank account, you probably want to ensure who that goes to. Likely the same with a life insurance policy or any investments. Or, an important special family heirloom.

Legal issues that can arise from your death without a will (intestate) can become major problems for your loved ones.

In the past, we have discussed some inexpensive precautionary actions you can take with estate planning to make life easier on your family should something happen to you. Creating a will is one of those. It doesn’t cost a lot, and in many cases isn’t very difficult to start with a little help.

Something you may not think about is inheritance/estate taxes. However, this is something you should carefully consider when estate planning.

The estate tax is often misunderstood. When a person dies, the estate potentially can face both federal and state estate tax. This is in addition to any income tax the decedent taxpayer owed and if their estate generates income during the time of probate, say from rental or interest income.

Pennsylvania Inheritance Tax:
There are significant exemptions for the federal estate tax, which often changes. Pennsylvania does not have an estate tax. Instead, Pennsylvania levies an inheritance tax. Unlike the federal estate tax, it is not charged against the entire estate; beneficiaries receive exemptions and the percentage of tax depends on which of the four classes of taxation that the beneficiaries belong.
