Martin wins in the United States Court of Appeals.
Appellant, Randolph County N.C. Sherriffs Department, (surviving three law enforcement officers), appealed denial of summary judgment. RSCO argued the egregious excessive force committed against Martin is protected under qualified immunity grounds. Today, the United States Court of Appeals ruled in favor of the Middle District of North Carolina, agreeing on the “obvious” fact - - these law enforcement officers are not immune for violence perpetrated against innocent civilians.
